These Terms and Conditions ("Terms") apply to all products and services offered on the SpeedySim website www.speedysim.com ("Website").
Please read them carefully, as well as our Privacy Policy, before proceeding, as they set out the contractual agreement between you (the "User") and us ("SpeedySim" or "Company").
You acknowledge that you have read and agree to the Terms, as well as to the Privacy Policy, when using SpeedySim, such as, but not limited to, browsing the website, purchasing products, and registering a user account. If you do not agree with both these Terms and the Privacy Policy, you are not allowed to use SpeedySim services and you must leave this website immediately.
1.0.1 These Terms, as may be amended from time to time, apply to all SpeedySim services directly or indirectly (through third party distributors) made available online, through any mobile device, by email, or by telephone.
1.0.2 By accessing, browsing, and using our website or any of our applications, and/or purchasing products or registering a user account, you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below including our Privacy Policy.
1.0.3 This website www.speedysim.com including its pages, content, and infrastructure and the services provided by us on these pages and through the website, are owned, operated, and provided by Big Dream Ventures B.V., and are provided for your personal, non-commercial use only, subject to the terms and conditions set out below.
2.0.1 Terms or expressions used in these terms and conditions are defined as follows, unless the context specifies otherwise:
'Application Form' is defined as the electronic form containing personal identification data and other user information to be inserted by the User and submitted to the Company in order to register a user account.
'Company', 'SpeedySim', 'We', or 'Us' means Big Dream Ventures B.V. a limited liability company incorporated under the laws of The Netherlands, with registration number 63338149.
'Customer Care' is defined as any service unit fully authorized by the Company to provide a range of services to support users with any issue using the service, to receive feedback, complaints as well as ideas on how SpeedySim can improve its service.
'Destination' means the country or region for which an eSIM Product provides mobile data connectivity.
'End User', 'User', or 'you', is defined as any web user accessing the SpeedySim website either directly or through third party distributors. An End User may also be a Registered User.
'eSIM Product' means a prepaid mobile data plan delivered through eSIM (embedded SIM) technology that can be purchased through the SpeedySim platform for use while travelling in one or more Destinations. An eSIM Product is activated using a QR code and/or a manual activation code and requires a compatible, unlocked device.
'Order' means the process of selecting and purchasing an eSIM Product through the SpeedySim platform. An Order is considered complete when SpeedySim confirms receipt and acceptance of the customer's payment for the Total Price.
'Partners' are third-party companies with whom SpeedySim has a direct contractual relationship. Partners include product suppliers, as well as technical service providers.
'Platform' means collectively the website www.speedysim.com including its pages, content, and infrastructure and the services provided by the Company on these pages and through the website.
'Product' or 'Products' is defined as any eSIM Product(s) that can be purchased on the SpeedySim website.
'Product Catalogue' is defined as the entirety of Products made available to be purchased on the SpeedySim website.
'Registered User' is defined as an eligible User who has successfully completed the registration process, accepted the Terms and has been assigned a registration number after acceptance by the Company.
'Service' or 'Services' refers to the services offered by SpeedySim to the User for the purchase of Products on the SpeedySim website and in accordance with these Terms.
'Supplier' is defined as any mobile network operator or eSIM technology provider from which the Company procures Products made available in the Product Catalogue, to be sold to Users.
'Terms' is defined as the terms and conditions of this agreement which governs the relationship between the User and SpeedySim. Wherever it is not expressly specified, Terms includes the Privacy Policy.
'Total Price' means the total amount payable by the User for the purchase of Products on the SpeedySim platform. This amount includes the price of the selected products, any applicable taxes, fees, and additional charges. The Total Price is displayed to the User prior to the completion of the transaction and represents the final amount to be paid.
'User Account' or 'Account' is defined as a record associated with a unique identifier associated to a Registered User and containing various information collected during registration or subsequently modified by the Registered User, as well as transaction history.
3.0.1 SpeedySim offers an e-commerce platform specialised in the sale of travel eSIM data plans ("Products") that can be purchased by the User using everyday (fiat) payment methods.
3.0.2 The Product Catalogue is organised on the Platform to show the available Products that can be purchased for a specific Destination.
3.0.3 For eSIM Products, the User can select the Product(s) they intend to purchase by choosing the Destination and the data plan (data allowance and validity period) offered by the Supplier for that Destination.
3.0.4 The User pays for the Product(s) using a payment method accepted by SpeedySim and displayed at checkout, within the time allowed to complete the payment.
3.0.5 In order for the payment to be valid, the User must complete the full payment within the time limit displayed on the payment page.
3.0.6 Once the Order is complete, the User will receive the eSIM Product's activation details (a QR code and/or a manual activation code) by email and/or in the User's Account, to be installed on a compatible, unlocked device ahead of travel.
3.0.7 The User is solely responsible for verifying, before purchasing, that their device supports eSIM technology and is unlocked from any other network. eSIM Products cannot be installed on incompatible or locked devices.
3.0.8 eSIM Products are for prepaid mobile data use only. It is not possible to convert an eSIM Product into a postpaid plan or to top up an existing SIM or mobile subscription using these Products.
3.1 Business to consumer
3.1.1 The SpeedySim service is provided to the User for personal, non-commercial (B2C) use only. If a business wishes to purchase products from SpeedySim it must first enter into a separate B2B agreement with SpeedySim.
3.1.2 Products purchased through SpeedySim may not be re-sold and shall be redeemed only either by the User, on the User's behalf or by someone to whom the User has gifted the Product.
3.2 Product availability and refunds policy
3.2.1 SpeedySim provides its services through a network of third-party Suppliers.
3.2.2 Transactions may, from time to time, fail due to technical or other reasons. The User acknowledges and agrees that SpeedySim may not be liable for a technical issue that affects its transaction. Whenever a transaction fails due to technical reasons, a User may qualify for a refund.
3.2.3 The Company will consider a transaction failed if it has received the correct User details and the correct payment amount and one of these cases occurs: (a) the User did not receive the Product; or (b) the Product was correctly delivered to the User but cannot be activated due to a fault attributable to SpeedySim or its Supplier. Upon being contacted by the User, SpeedySim will investigate the issue. Once the appropriate investigation is made, and SpeedySim deems there is no fraud or foul play by the User, the User will be eligible for a refund.
3.2.4 SpeedySim will not refund Users if: (a) the User does not comply with the Terms or other policies of the Supplier in relation to activating the Product; (b) the User provided wrong contact, device or destination information resulting in the Product being unusable; (c) the User's device is not eSIM-compatible or is locked to another network; or (d) the User violated these Terms.
3.2.5 Determining if the User has the right to a refund can be complicated and can take time. While most refunds are completed within 2 business days, SpeedySim reserves the right to a 2-week period from the date the issue occurred to investigate and decide whether to apply the refund.
3.2.6 Refunds are made by SpeedySim via the original payment method used by the User, where technically possible, or by an alternative method agreed with Customer Care. The Customer Care may offer the User the possibility to receive the Product initially requested or an alternative Product instead of the refund.
3.2.7 Refunds must be requested within 30 days from the date of the transaction. For refund requests, the User shall contact support@speedysim.com.
3.2.8 Once a Product has been activated, no refunds or reimbursements will be offered.
3.2.9 Any attempt by users to obtain products or refunds in a fraudulent manner is considered a criminal offence, and as such will be communicated to the relevant authorities.
3.3 User accounts
3.3.1 SpeedySim offers the possibility for eligible users to register a user account. A User may only submit one application form and may have only one user account. The user account must be in the Registered User's legal name and must be associated to a valid email address. The User guarantees the correctness of all information given.
3.3.2 In case of duplicate accounts, the Company reserves the right to cancel one or both accounts and cancel any associated benefits.
3.3.3 The user account cannot under any circumstances be transferred, assigned, sold or combined with the account of any other person.
3.3.4 The Registered User is responsible for the usage of their password and shall not disclose the password to any third party.
3.3.5 All users registering an account on SpeedySim shall be deemed to have read and accepted these Terms as well as the Privacy Policy.
3.4 Customer care
3.4.1 To resolve an issue when using the SpeedySim service, the User must get in touch with Customer Care through the appropriate channels:
a. Completing the online contact form at www.speedysim.com/contact-us
b. Sending an email to: support@speedysim.com
3.4.2 If contacted through the appropriate channel, Customer Care will do its best to provide a first reply within 24 hours, but it may take longer depending on the issue and the total number of requests being processed.
3.5 Third-party payment methods
SpeedySim may offer Users multiple payment methods, including payments processed directly by SpeedySim and payments facilitated through third-party payment providers or gateways.
Third-party payment methods are operated by independent third parties and are subject to their own terms and conditions. SpeedySim does not control, operate, or guarantee the availability, performance, security, or compliance of any third-party payment provider.
SpeedySim is not responsible for delays, failures, reversals, or losses arising from the use of third-party payment methods. Once a payment is completed and confirmed in accordance with the rules of the selected payment method, the transaction is final.
Users are solely responsible for understanding and accepting the terms, conditions, and risks applicable to any third-party payment method they choose to use. SpeedySim disclaims any liability arising from a User's use of third-party payment providers.
4.0.1 In accordance with the Company's compliance policies, we may request certain information from the User and limit the amounts that Users can spend on Products within specific time frames. Applicable limits are displayed at checkout and may vary by product category, user verification level, and applicable regulations.
4.0.2 Any User creating or using more than one SpeedySim account, or any other means to circumvent spending limits, is in breach of these Terms and may result in SpeedySim suspending the account(s). Where required by applicable laws and regulations, any illegal circumvention of spending limits may be reported to the relevant authorities.
5.0.1 The design, service, content, texts, logos (including the SpeedySim logo, the word SpeedySim) and any proprietary software and technology developed by SpeedySim is the exclusive property of SpeedySim, and is protected by copyrights, trademarks, service marks, international treaties, and/or other intellectual proprietary rights and laws of the Netherlands and other countries.
5.0.2 These Terms grant the User no right, title, or interest in any intellectual property owned or licensed by SpeedySim, including but not limited to, the Platform, Service and SpeedySim trademarks.
5.0.3 Logos and trademarks used to identify third-party mobile network operators are the property of the respective Suppliers and/or other third parties. Such logos and trademarks are used to identify the Product and/or its Supplier. SpeedySim does not claim any ownership, license, authorisation, partnership or agreement with the owners of such logos or trademarks.
6.0.1 SpeedySim has concluded agreements with mobile network operators and eSIM technology providers to purchase Products from Suppliers in its own name. SpeedySim sells the Products in its own name to its Users. As such, SpeedySim is a reseller of the Product.
6.0.2 Unless otherwise expressly mentioned, SpeedySim is not sponsored by any Supplier, nor are we related to, acting on behalf of, or under express authorisation of any Supplier.
6.0.3 Before purchasing an eSIM Product on SpeedySim, the User is required to engage in adequate due diligence of the terms and conditions of the Product being acquired, including device compatibility, coverage area, data allowance, validity period and any speed or fair-use restrictions. SpeedySim will not accept or be liable for any claims in relation thereto.
6.0.4 SpeedySim makes no representation regarding the Product's suitability for its intended use and makes no other guarantees, warranties or representations in respect of the Product, including in relation to network coverage, signal quality or data speeds provided by the Supplier's network.
6.1 Responsibility of the user
6.1.1 The User is fully liable for any mistakes, losses or damages (against themselves, us, or any third-party) arising from (i) the provision of incorrect, inaccurate or fake information and from (ii) the acquisition, resale, use or other related activities of the Product in a manner that infringes any applicable laws, regulations, or contractual terms.
6.1.2 The User is solely responsible for the accuracy and correctness of the information provided (including, but not limited to, email address, device model and eSIM compatibility, and the Destination selected). SpeedySim shall not be liable for any consequences arising from the inaccuracy of the information provided by the User.
6.1.3 A Registered User is responsible for maintaining the confidentiality of their password and account and for any activities and transactions that occur under their account.
6.2 Unlawful use
6.2.1 The SpeedySim services, Platform and any Products purchased from SpeedySim shall not be used, in any way, to infringe or circumvent applicable laws and regulations.
6.2.2 SpeedySim will restrict User access, terminate Registered User accounts and communicate to the relevant authorities any User activities should SpeedySim become aware, or reasonably suspect, that a User is conducting unlawful activities or otherwise breaking applicable laws and regulations or third-party rights.
6.2.3 Those who choose to access SpeedySim do so on their own initiative and are responsible for compliance with all local laws and regulations. If it is illegal or prohibited in the User's country of origin to access or use SpeedySim, or to buy or use any of the Products, then the User shall not do so.
6.3 Limitation of liability
6.3.1 SpeedySim shall in no event be responsible or liable to the User, Suppliers or any third party, whether in contract, warranty, tort (including negligence) or otherwise, for any loss or damage arising out of or related to the Service or Platform, including but not limited to, special, incidental, exemplary, punitive, direct, indirect or consequential damages, damages for any loss of profit or revenue, injury to person or property, business interruption, or loss of business or personal information, even if SpeedySim is advised of the possibility of such damages. Such limitation shall apply to the fullest extent permitted by law.
6.3.2 In jurisdictions that limit the ability to disclaim liability, SpeedySim's liability shall be limited to the greatest extent permitted by applicable law.
6.3.3 No members of the SpeedySim team (including employees, contractors, directors, management members and other collaborators) shall have any liability in relation to the use of, or reliance upon, SpeedySim or the Products purchased by Users.
6.3.4 SpeedySim accepts no responsibility whatsoever for viruses, malware or other malicious or damaging software on User's devices.
6.3.5 The SpeedySim website may include links to third-party websites. SpeedySim has no control over these third parties or over the content, products, services and technologies they offer, and therefore does not accept any responsibility whatsoever for third-party sites available through SpeedySim via hyperlink.
7.0.1 Our Privacy Policy defines how SpeedySim collects, processes, accesses, stores and deletes User data.
7.0.2 The User shall visit and review our Privacy Policy and shall not proceed with using SpeedySim if the User does not agree and consent with it. Users are required to accept the Privacy Policy when applying for a Registered Account.
8.1 Amendments to the terms
8.1.1 SpeedySim reserves the right to amend these Terms at any point, without any obligation of prior and/or public notice. As such, Users shall refer to the present page before browsing the SpeedySim website and before completing any purchase.
8.2 Jurisdiction
8.2.1 These Terms shall be governed by and construed in accordance with the laws of the Netherlands. The User agrees to submit to the jurisdiction of the Netherlands courts to settle any disputes arising in connection with these Terms.
8.3 Enforceability
8.3.1 In the event any provision of these Terms is determined to be invalid or unenforceable, such provision shall be deemed severed from the remainder of these Terms and replaced with a valid and enforceable provision as similar in intent as reasonably possible, and shall not cause the invalidity or unenforceability of the remainder of these Terms.
8.4 Entire agreement
8.4.1 These Terms, together with the Privacy Policy, set forth the entire agreement between the User and SpeedySim with respect to the subject matter hereof and supersede all prior agreements relating to such subject matter.
